CHEDWORTH PLACE AND SAMFORD COURT ESTATE

This brief is intended to assist purchasers and their solicitors to understand the history of the Estate since its creation in 2002 and to explain any reference to Regis Group, Decorfine Ltd and Landfast Ltd within documentation

In 1998, Regis Group acquired the former hospital and its grounds and later that year they succeeded in obtaining planning permission for the conversion to what are now the separately owned dwellings in Chedworth Place and Samford Court.

Regis Group sold the majority of the site to Decorfine Ltd as Title number SK192946 in September 1998 but retained (and continue to own) an area of land to the west of the site extending to circa 2 acres under Title number SK127355. In the sale, Regis Group retained a vehicular right of way to this area, leading from Church Road via the Chedworth Place driveway.

In March 2000, Decorfine Ltd sold the site under the same Title Number SK192946 to Landfast Ltd who undertook the conversion of the existing buildings to housing as well as the construction of several new build houses.

By 2002, the 33 houses were complete and they were individually sold, together with their gardens and car parking spaces, by Landfast Ltd to their new owners. Landfast Ltd retained the ‘common land’ (being the driveways, lawns, central garden, paths and woodland) extending to about 7 acres, and until 2025 the owners of the houses paid Landfast Ltd (via their managing agent) two separate fees, one for grounds maintenance (calculated by reference to the previous year’s expenditure) and one for a sinking fund (to build up a capital reserve for occasional one off projects).

In 2024, residents of Chedworth Place and Samford Court formed a company called Chedworth and Samford Estate Ltd (CASE) as a vehicle to purchase the ‘common land’ from Landfast Ltd and in January 2025, CASE acquired the ‘common land’ for the sum of £64,000.

CASE is a company ‘limited by guarantee’, which means it has members rather than shareholders, and is non-profit making. The limit of each Member household’s  liability is set at £1.

At present 30 of the 33 households are CASE members, which means they hold a joint ownership in the 7 acres of ‘common land’ having contributed to the purchase. When the three non-participating houses are sold, the new owners are strongly encouraged to become members of CASE and share in the benefit of owning the ‘common land’.

Members have a say in CASE’s policies and the appointment of its directors, and the rules governing CASE. The company structure can be found in its Articles of Association, available on the Companies House website by following the link below.

The Estate also benefits from an active Residents’ Committee (ResCom), an informal group of about nine residents who represent all householders on issues concerning the Estate. In practice, the principal roles of the directors of CASE and the members of ResCom are to deal with maintenance of the ‘common land’ (liaising with the contracted gardener and dealing with any repairs) and finance (dealing with budgeting the annual service charge and the sinking fund).

CASE engaged the current managing agent called Home from Home Property Management Ltd based in Ipswich in January 2026.  Their main role is the invoicing, management and collection of the annual service charge and sinking fund contribution. They also advise and assist on accounting, maintenance and legal issues, as well as assist in engaging contractors.
